BOOKING, PAYMENT, CANCELLATION & SECURITY DEPOSIT POLICY AGREEMENT


By proceeding with this reservation, I acknowledge, understand and expressly agree to the following terms and conditions:


1. RESERVATION CONFIRMATION

A reservation shall be considered confirmed only upon receipt of the required advance payment as communicated by the Company.


2. PAYMENT TERMS & CANCELLATION POLICY

As per the selected Villa Reservation.

3. SECURITY DEPOSIT

A refundable security deposit of 2.000€ must be received in the designated company’s bank account or by credit card no later than seven (7) days prior to arrival, unless otherwise agreed in writing by the Company. In case both Celestial villas are rentrered together, damage deposit will be 4.000€ 

The security deposit serves as security for any damages, losses, excessive cleaning costs, or breaches of the rental terms occurring during the stay and shall be returned to the client within fourteen (14) days after their departure and after having received confirmation that there is no damage.


4. FAILURE TO COMPLY WITH PAYMENT OBLIGATIONS

The Guest expressly acknowledges and agrees that failure to make any required payment, including the advance payment, balance payment or security deposit, within the deadlines specified by the Company shall constitute a material breach of the reservation terms.


In such event, the Company reserves the absolute right, at its sole discretion and without further notice, to:

• cancel the reservation immediately;

• refuse check-in and deny access to the property;

• release the property for re-booking to third parties; and

• retain any amounts already paid, subject to the applicable cancellation policy.


The Guest further acknowledges and agrees that the Company shall bear no liability whatsoever for any losses, expenses, travel costs, accommodation costs, damages, or claims arising from such cancellation or refusal of check-in due to the Guest's failure to comply with the payment obligations set forth herein.

In this case, the Guest expressly and unequivocally waives their right to bring proceedings before any court within the Greek territory or abroad, of any jurisdiction, and to file any claim against the company, asserting claims for compensation for any damage they allege to have suffered as a result a) of the cancellation of the reservation or / and b) the company’s refusal to grant access to the leased property or / and c) the retention by the company of any amount already paid, whether as a deposit or as partial payment for the services agreed to be provided, where they have failed to fulfill the obligations they undertook.

Failure to settle the outstanding balance and / or provide the required security deposit by the applicable deadline shall be deemed a voluntary cancellation by the Guest and shall be treated in accordance with the Company's cancellation policy.

5. OCCUPANCY RESTRICTIONS

• Registered guests only.

• No subletting.

• No transfer of reservation.

• Pet allowance upon written consent and

• Compliance with all applicable quiet hours and noise regulations.


6. EVENTS & PARTIES

No parties, celebrations, weddings, photoshoots, commercial filming, corporate events or gathering are permitted without prior written consent.

7. POOL & SAFETY WAIVER

The Company shall bear no liability in the event that any guest of the villa sustains bodily injury during the use of the garden, swimming pool, etc. (whether indoors or outdoors), or as a result of any activity of any nature whatsoever that may take place within the villa or in its surrounding premises.

8. RIGHT TO REMOVE GUESTS

The company reserves the right to immediately terminate the stay and remove any guest who violates these terms, causes disturbance, damages to the property or poses a risk to persons or property.

9. LIMITATION TO LIABILITY

The Company shall not be held liable for any failure to perform, delays, damages or losses resulting from events beyond its reasonable control, including but not limited to:

Theft: Any loss, damage, or theft of personal belongings or property belonging to the client/user.

Accidents: Personal injury, accidents or medical emergencies occurring during the use of services, provided all safety guidelines have been communicated.

Power Outages: Disruptions, surges or total blackouts in electricity supply caused by public utility providers.

Internet Disruptions: Any failure, downtime, or interruption of internet connectivity, server issues, or telecommunication network errors.

Force Majeure: The Company shall not be liable for any failure, delay, cancellation, interruption or inability to perform its obligations where such circumstances arise from events beyond its reasonable control, including but not limited to natural disasters, earthquakes, floods, severe weather conditions, fires, pandemics, governmental restrictions, strikes, war, civil unrest, terrorism, transportation disruptions, utility failures or any other force majeure event. In such circumstances, the Company reserves the right to suspend, modify or cancel the reservation without liability, subject to the provisions of the applicable cancellation and refund policy.

10. DATA PROTECTION POLICY

By making a reservation, the Guest acknowledges and agrees that the Company shall collect, store, process and use personal data, including but not limited to name, contact details, nationality, passport or identification information, payment details and guest registration information received no later than 7 days before arrival.

The Company shall process personal data only for legitimate business purposes and shall implement appropriate technical and organizational measures to protect such data against unauthorized access, disclosure, alteration or destruction.

The Guest acknowledges and agrees that, upon arrival and prior to check-in, the Company may request the presentation and verification of a valid passport, national identity card or other official identification document for the purpose of confirming the Guest's identity, in order to ensure the security of the property and its occupants.

Copies of the above - mentioned documents, as well as any identity document relating to any villa guest, may be retained by the Company in its records for a period of up to two (2) years following the guest’s departure from the villa. Upon expiration of the aforementioned period, the Company shall be obliged to destroy such documents, whether they exist in physical form or in electronic format.

11. Governing Law & Jurisdiction

These terms and conditions shall be governed by the Greek Law. Any dispute arising out of or in connection with this Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

12. ACCEPTANCE OF TERMS

By selecting the acceptance box and / or completing the reservation process, I confirm that I have read, understood and accepted these terms and conditions and that they shall be legally binding upon me and all members of my party.


GUEST ACKNOWLEDGEMENT

I expressly acknowledge that the reservation remains subject to timely payment of the advance payment, the remaining balance and the security deposit. Failure to comply with any payment deadline may result in cancellation of the reservation and/or refusal of check-in without any liability on the part of the Company.
